Parents sue then-14-year-old driver in fatal crash

SOUTH BEND — The parents of a 12-year-old South Bend boy killed in a December crash have filed a wrongful death lawsuit against the then-14-year-old boy who was driving the SUV.

The lawsuit filed by Randi and Kent Downhour argues that the teen was driving without a license and at an unsafe speed when the SUV went into a ditch and rolled over several times. The crash killed Corey Downhour, who was a seventh-grader at Greene Intermediate School.

Attorney Michael Anderson tells the South Bend Tribune the Downhours filed the lawsuit because they've not been able to find out how the 14-year-old ended up driving the SUV.

The Tribune reports no charges have been filed in the case and it remains under review by the St. Joseph County prosecutor's office.
